Order
- [The tenant/s] owes Kāinga Ora – Homes and Communities $1,318.00 for rent arrears to the end of 8 July 2026.
- [The tenant/s] must pay rent and the rent arrears as follows: a. By 82 weekly payments of $114.00, being $98.00 for rent and $16.00 for the debt. b. A final payment of $104.00, being $98.00 for rent and $6.00 for the debt. c.Payments will be every Wednesday, with the first payment on 15/07/2026 and continuing until 09/02/2028. d. The above weekly rent of $98.00 per week may be varied in accordance with the Residential Tenancies Act 1986, in which case the weekly rent payments referred to above shall vary accordingly. However, the minimum $16.00 per week rent arrears repayments shall remain constant.
- Payments will be allocated in the following order: rent, rent arrears.
- If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at 9 Jellyman Place, Springlands, Blenheim 7201 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- The hearing was conducted remotely on Microsoft Teams.
- Susan Rea attended for the landlord.
- The tenant did not attend. The hearing proceeded in her absence.
- The landlord originally applied for termination of the tenancy and rent arrears.
- However, the Ms Rea says the landlord would be content with a conditional order today because the tenant is now regularly paying rent and $16.00 per week towards the arrears.
- I am satisfied that the rent arrears as at the end of yesterday are $1,318.00.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order pursuant to s 55(1)(a) and (1A) of the Residential Tenancies Act 1986.
- Because the landlord seeks only a condition order, I make a conditional order in the terms set out above.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach by virtue of s 64(4)(b) of the Residential Tenancies Act 1986.
