He explained that he and his wife have lived at the property for approximately 30 years, making securing alternative accommodation particularly difficult. He also 5510429 2 noted that the property serves as a place where their grandchildren regularly visit and is conveniently located within walking distance of them. In addition, the Tenant’s wife has suffered a stroke, and he has faced the considerable challenge of balancing her care needs, his work, and the search for suitable rentals.

Section 51(1) of the Residential Tenancies Act 1986 provides that a landlord may terminate a periodic tenancy by giving at least 90 days’ notice.

In considering the evidence, I am satisfied that the Landlord gave the required notice for termination. I acknowledge the significant personal circumstances of the Tenants and accept that relocating after a long residence in the property would be challenging. However, the Tribunal’s role is to apply the law and there is no discretion to refuse a termination based on hardship or personal circumstances. The issues relating to the Tenants’ eligibility for social housing should be discussed with MSD rather than the Tribunal.

I am satisfied that the Landlord is entitled to possession of the premises. The tenancy is therefore terminated, and the Tenants must vacate the property on or before 16 July 2026.
