Reasons

This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to her in the Notice of Hearing. Nor did the tenant ring in to the hearing as directed by that same notice. Further to this, both calls I made to her telephone went to voicemail. The hearing therefore proceeded in her absence.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations. 5510770 2

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The background to this claim is that the tenant has breached their obligations by creating a biohazard and/or substantially damaging property the premises in which she is living. This occurred during an assault on her boarder which caused a considerable amount of blood to be spilled just outside the front door to the property and also a lot of blood on the carpet inside the property.

The landlord served a 14-day notice on the tenant on 30 April 2026, requiring her to remedy this issue.

Photographs taken on 19 May 2026 show that the tenant has not remedied this breach. There remains a considerable blood stain outside the front door and more blood stains inside the premises.

It would be inequitable to refuse to terminate the tenancy because these blood stains constitute a bio hazard, not only to the tenant but also to her neighbours given that the pathway outside the front door is used by other tenants. It is also unreasonable to expect a landlord to tolerate such damage to premises.

Further to this, the photographs taken on 19 May 2026 indicate an indifference to whether or not the premises are damaged in this way because there seems to have been very little attempt at cleaning away the blood.

The tenancy is therefore terminated. Filing fee reimbursement
