Both parties attended the hearing.

This is a landlord application seeking termination of the tenancy for sexual harassment and rent arrears. The tenant has remedied most of the rent arrears and has an appointment with WINZ this week to finalize the remaining rent arrears.

The landlord was able to provide the Tribunal with the tenant’s updated mobile number for him to be contacted for the hearing. Mr. Kopua has not been provided with the landlord application and supporting documents.

I read the content of the landlord application, and Mr. Kopua appeared shocked at the allegations of sexual harassment.

Given the seriousness of the allegations and the potential consequences to Mr Kopua, I must adjourn the hearing to allow him to receive the application and documentation. Mr Kopua must be fully aware of any claims made against him and be in a position to respond as required.

There was a friend of Mr Kopua present at the time of the alleged incident who may be available to assist Mr Kopua at the hearing. It is in the interests of justice and fairness that the hearing is adjourned for these reasons.

However, it is important that these claims are dealt with expeditiously and so I ask for an urgent hearing to be scheduled within the next few weeks.
