Reasons

On 19 June 2026 the landlord filed an application seeking termination of the tenancy for breach of the tenant’s obligations.

The hearing proceeded by way of video conference. Mr Hayden Mai and Ms Courtney McKenzie, Property Managers appeared for the landlord. The tenants failed to appear. The Tribunal was satisfied the tenants were properly served with the notice of hearing and the case proceeded in their absence.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986 (the “Act”).

Where the breach is not capable of remedy, the landlord is not expressly required to serve a 14-day breach notice on the tenant. A breach is not capable to remedy where the thing done, or its effect, cannot be undone.

However, unless the breach is serious, the Tribunal usually requires the landlord to have warned the tenant about the likely consequences of continued breach before it will exercise its discretion to terminate.

The landlord states the tenant has breached their obligations by using the property for the unlawful purpose of cultivating cannabis. See section 40(2)(b) of the Act.

The cultivation of cannabis is illegal and a breach of the Misuse of Drugs Act 1975.

The landlord gave evidence that on 18 June 2026 they were notified by the New Zealand Police that a search warrant had been executed at the property because it had been used in the cultivation of cannabis.

The landlord provided an email from the Police which confirmed they had executed a search warrant at the property and located a commercial quantity of Cannabis plants, in total 161 plants were discovered.

The landlord produced photographs which show evidence of a commercial cannabis grow operation. The windows had been covered, the floors covered with plastic sheeting, there were multiple pot with soil and evidence of cannabis plant material, and plant supports had been suspended from the ceiling.

In addition there ventilation ducting had been installed throughout the property along with lighting which the landlord said had been connected to the electrical supply by passing the properties electrical wiring.

Having heard from the landlord and considering all of the evidence the Tribunal is satisfied the tenant has used the premises for the purposes of cultivating cannabis. Cultivating cannabis is an illegal and a breach of the Misuse of Drugs Act.

The breach is serious and not capable of remedy. The cultivation of cannabis plants has occurred, and cannot be remedied.

I am satisfied that the breach is sufficiently serious to warrant termination of the tenancy. That is because the tenant has intentionally engaged in criminal activity in the property in breach of their obligations. It would be inequitable to refuse to terminate the tenancy and, accordingly the tenancy is terminated. Other matters

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.

Section 95A of Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that the name or identifying particulars not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case. The landlord has been wholly successful and is granted suppression.
