The landlord has applied for termination of the tenancy for abandonment, rent arrears, outgoings and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 2 July 2026 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The tenant’s ex-partner (and neighbouring tenant) advised the landlord that the tenant had left the premises with clothes that day and has since advised the landlord he will not be returning. The tenant has not been in contact with the landlord or responded to their communication.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing as at 8 July 2026 is $1,182.86. I have made an order for rent arrears to the hearing date. Because this is a fixed term tenancy the tenant will continue to be liable for rent until the end of the fixed-term or until the commencement of a new tenancy of the premises.

The landlord provided evidence of electricity readings to prove the tenant owes $270 for electricity for the period 1 December 2025 – 20 May 2026. The power company invoices have not been provided however the landlord provided the owners invoice that was directed to the tenant and a spreadsheet which records the meter readings provided by the tenant calculated on a set rate set out in the schedule. In the circumstances where the tenant has provided the meter readings, he been served with the claim and calculations and has not challenged the calculations, I will award the amount claimed.

The hearing for this matter was on 9 July 2026. On 5 July 2026 the landlord asked to amend the claim to include compensation for a carpet stain in the bedroom. The work has not been completed and the claim was not filed to allow the tenant 5 days' notice of the claim. I declined to hear that matter but have adjourned the claim.

Because the landlord has wholly succeeded with the claim, I must reimburse the filing fee.

The bond is to be paid to the landlord immediately to offset the rent arrears.

The hearing is adjourned. The landlord’s claim is amended to include compensation - carpet cleaning ($186)

At the next hearing I will determine any additional claim for rent arrears and the claim for gas (the landlord will file the invoice for the gas bottle). Any additional claims will require a fresh application to be filed,
