Order

[The tenant/s] tenant/s] must carry out work at the premises as follows: a) Mow the lawn and remove all rubbish from the exterior of the premises; b) Remove the bed and rubbish from the garage; c) Remove rubbish from the floor inside the house; d) Clean the carpet and linoleum flooring; e) Wipe dirt and grime from all wall surfaces; f) Clean the bathtub, bathroom sink and toilet; g) Repair holes in walls; and h) Replace damaged internal doors.

[The tenant/s] tenant/s] must carry out the work set out above by Sunday 30 August 2026.

If the tenant fails to complete the work set out above within 5 working days of 30 August 2026: a. The tenancy at 152 Awakino Road, Dargaville 0310 will terminate and the landlord will have immediate possession of the premises.

Reasons

The landlord attended the remote hearing held on 14 August 2026. The tenant did not attend the hearing. An attempt was made to join the tenant to the hearing by telephone, but the call was not answered.

The landlord has applied for termination of the tenancy due to the tenant failing to keep the premises reasonably clean and reasonably tidy which is required by the Residential Tenancies Act 1986 1 .

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days, and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.

The tenant breached their obligations by not keeping the premises in a reasonably clean and tidy condition. The landlord served multiple 14-day notices on the tenant in relation to the condition of the premises. The most recent 14-day notice was served on 1 July 2026, but the breach was not remedied within the required period.

It would be inequitable to refuse to terminate the tenancy. The landlord carried out an inspection on 24 June 2026 and identified issues both externally and internally at the premises. After serving the 14-day notice a further inspection was carried out on 16 July 2026 and the report from that inspection was produced for the Tribunal. It records that the breaches have not been remedied and the photographs show very dirty carpet, unmown lawns and a large pile of rubbish outside which I note was in the inspection report dated 24 June 2026.

The landlord has produced the ingoing inspection report from December 2021 which shows that the carpet was in much better condition and the damage to the walls and doors was not present at that stage.

The landlord has obtained a quote to carry out the work required to bring this property to a liveable condition. The quote is more than $6,000.00. This shows that the amount of work required is significant.

Despite my finding that it would be inequitable to refuse to terminate the tenancy, having heard the evidence I am satisfied the tenant should be provided 1 Section 40(1)(c) Residential Tenancies Act 1986 with an opportunity to comply with the tasks set out above. I have granted a conditional termination 2 .

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
