The tenancy of [The tenant/s] at 37C Seaview Road, Paremata, Porirua 5024 is terminated, and possession is granted to Lifestyle Rental Properties Limited, at 5pm on Friday, 31 December 2021 unless $600.00 is paid by 22 December 2021 and $600.00 is paid each week after 22 December, in which case the tenancy will terminate at 5 pm on Sunday, 30 January 2022.

[The tenant/s] did not attend the hearing.

The landlord has applied for termination of the tenancy and rent arrears.

I am satisfied that although the tenancy for [The tenant/s] for 37C Seaview Road, Paremata was not signed by her, she was fully aware, in occupying the property and in conversations and texts, that rent of $600.00 was to be paid by her to the landlord. She was effectively renting the upstairs area by agreement with her daughter. It is clear from the evidence that her daughter knew, by January 2021, that she would not be able to stay at the property when the previous upstairs tenants left. By then the Council had informed the owner that the upstairs could not be rented as a separate household unit. She tried to negotiate a combine rent but there was no meeting of minds with the landlord about a fair rental. A written tenancy agreement was sent to Ms Royal for rent of $600.00 per week and it was signed by her daughter. However the agreement was not for her daughter to pay extra rent. It was for Ms Royal to take to Winz to get an accommodation assistance payment. Ms Royal has not paid any rent since occupying the property.

The order for rent arrears is against Ms Royal only.

The tenancy must be ended because of the amount of arrears.

The date of termination is conditional on the payment of rent.

Because Lifestyle Rental Properties Limited has wholly succeeded with the claim I must reimburse the filing fee. .
