This matter was originally part-heard before me on 10 May 2023. At that time a possession order was made in favour of the landlord and the remainder of the claims were adjourned.
Today when the hearing resumed, the landlord indicated they wished to pursue the claims for rent arrears and damages.
Further evidence had been filed prior to this hearing date which suggested that the tenant had sub-let the premises and had been operating the premises as a boarding house.
For that reason, I indicated to the tenant that I was likely to find that he was liable for rent up to the date the landlord regained possession and liable for at least some of the damage.
I also indicated to the landlord that it was unlikely that the full replacement or repair costs were likely to be ordered, because the Tribunal must take into account betterment and depreciation.
The parties agreed to engage in a discussion to see if settlement could be reached. The parties have agreed to a figure of $25,000 plus the rent arrears in full and final settlement of their dispute.
That is reflected in the order above.
The tenant indicated that he could pay $5,000.00 to the landlord today with the balance in a month. The landlord needs the funds promptly as they owe money to tradespeople. The tenant has agreed to pay the balance as soon as possible.
I would like to thank all parties for engaging in a good faith discussion.
