The tenant has reduced the rent arrears considerably since the application was filed. However, the landlord still pursued termination today as the landlord says that there is a repeated pattern of the tenant getting into arrears and then catching up only to fall into arrears again. The landlord says that this makes it very difficult to budget and manage the tenancy.

The Tribunal must terminate the tenancy, if at the date of the application the rent is 21 days in arrears.

The tenant says that she has withheld rent due to an ongoing dispute between her and her neighbour, who is also a tenant of the landlord. The tenant says that she has withheld rent in order to get her property manager to return calls and deal with the ongoing problems. I have advised the tenant that withholding rent is not wise as it is a fundamental obligation of a tenant to pay rent and if they find themselves three weeks behind then they are likely to face a claim for termination. It is better if tenants bring ongoing disputes Tribunals attention by filing a claim.

The tenant wants to move away from the property but has had some difficulty finding another place to rent. I have therefore with the agreement of the landlord, terminated the tenancy 28 days from today. This will give the tenant time to find somewhere else to live. The tenant must continue to pay rent each week.
