An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant’s name and identifying details.
Yanan Lu must pay [The tenant/s] $220.44 immediately, calculated as shown in table below:

Reasons

Both parties attended the hearing.
The tenant seeks compensation of $10,000 against the landlord for: a. breach of her privacy and quiet enjoyment when the landlord installed a CCTV camera in the lounge area; b. issuing her with an invalid notice of rent increase; and c. issuing her with a 2 weeks’ notice to leave the premises.
The tenant rented an en-suite bedroom at 8F Buckley Road from the landlord for $280.00 per week. The parties entered into a standard tenancy agreement under the Residential Tenancies Act 1986.
The tenancy gives the tenant exclusive occupation of the en-suite bedroom with shared facilities in the common areas such as the lounge area, kitchen and laundry.
Power and water are included in the rent.
Traversing each of the tenant’s claims, I do not consider that the tenant’s quiet enjoyment and privacy have been breached when the landlord installed a CCTV camera in the lounge area. The lounge is common area in which none of the tenants (including A) have exclusive occupation and use. I do not accept that the tenant has a right to unfettered peace and quiet enjoyment, and total privacy while in the common areas of the property.
I accept the landlord’s evidence that she was concerned with the general security of the house. No cameras have been installed inside the tenant’s bedroom.
While the landlord has issued an invalid notice of rent increase, the tenant did not pay the extra rent demanded. Consequently, the tenant suffered no loss from the issuance of the invalid rent increase notice.
Lastly, I accept that the tenant has suffered stress and inconvenience in having to look for another place to move to urgently after the landlord unlawfully issued a 4 weeks’ notice instead of 90 days’ notice to the tenant (due to the premises being required as the principal place of residence for the owner’s mother). I consider an award of general damages of $200.00 appropriate in the circumstances. The tenant has found alternative accommodation in a short period of time and the tenant, subsequently gave 2 weeks’ notice to the landlord which was duly accepted by the landlord.
Only the amounts ordered are proved.
Because [The applicant/s] has partly succeeded with the claim I have reimbursed the filing fee.
