Reasons

Both parties attended the hearing. [The landlord/s representative] represented the landlord. The parties agree that the house the tenant is renting leaks and has done since she moved in. The owner has arranged for tradespeople to patch and silicon the roof, but he is unwilling to replace the roof because the house is being demolished. I have seen the resource consent for this work dated 2021. I have also been provided with a letter from the local council which shows there is building consent until June 2022. The tenant knew the house would be demolished, and her tenancy agreement states there is an exemption from the Healthy Homes Standards. However, she did not expect the house would leak, and there are other maintenance issues which have not been fixed.

[The landlord/s representative] and the tenant agreed at the hearing that the tenant can move out as soon as she finds another place to live. It is the intention of the parties that the tenant can move at short notice, and that she does not have to give any specific notice period or number of days. It will be sufficient that she gives the landlord notice in writing. The bond is to be released immediately to make things easier for the tenant, so she can pay the bond up front for her next tenancy.

The tenant has also claimed $250 compensation for visits to the doctor and prescriptions. This claim was challenged by the landlord, and the tenant accepts she does not have any evidence with her today linking the conditions in the house with the costs of medical help. I am not persuaded I should allow the claim for medical costs. However, I do make an order the landlord pay compensation because I find there has been a loss of amenity. The landlord has an obligation under section 45 of the Residential Tenancies Act 1986 to provide and maintain the premises in a reasonable state of repair. It is agreed evidence the tenant has not had a house free from leaks, which is a loss of amenity. The small amount of compensation claimed - $250 - is allowed.

Because the tenant has wholly succeeded with the claim I must reimburse the filing fee. The tenant’s application for suppression is also allowed because she is the most successful party.
