Only the landlord attended the hearing. A call was placed to the tenant but that call went to voicemail. I am satisfied that the tenant has received notice of the hearing and so the hearing proceeded in the tenant’s absence.
This matter was originally set down for hearing on 6 July 2023. However on the morning of the hearing the tenant sought an urgent adjournment for family reasons, advising the Tribunal that she would file supporting documentation later (although none has been received). The adjournment was granted and the matter was set down for hearing today.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.
The tenant has not paid any rent since 12 April 2023. The landlord filed a 14 day notice on 24 April 2023, requiring the tenant to rectify the breach (at that stage rent arrears of $750) but the notice expired on 8 May 2023 without the tenant rectifying the breach.
