Reasons

The tenant attended the hearing. The landlord did not attend. I conducted the hearing by phone. The registrar’s call to the landlord went to voicemail.
The tenant has applied for the partial refund of her bond and for compensation for her double bed and mattress which the landlord has kept.
The Tribunal needs to consider whether the fact situation falls within its jurisdiction. If the parties were flatmates, the tenancy would be excluded from the Residential Tenancies Act 1986 (RTA) due to the section 5 exclusions. The claim would need to be determined in the Disputes Tribunal.
The tenant gave evidence that establishes that she was a sub-tenant of the landlord. The landlord was a tenant of another landlord, the tenancy managed by a professional property management company.
The Tribunal has therefore proceeded on the basis that this was a separate sub tenancy and is therefore within its jurisdiction.
The tenant paid a bond of $800.00 and rent of $230.00 per week which included expenses.
The landlord failed to refund the bond when the tenancy ended on 26 November 2022.
The tenant agreed that the landlord could retain $60.00 from the bond as compensation for the replacement cost of broken glassware. She seeks a refund of $740.00 only.
