Reasons

The application seeks rent arrears and re-payment of an amount advanced to Ms Hastings near the end of the tenancy.
The hearing took place today in Whangarei. Mr & Mrs Gally attended the hearing. There was no appearance by the tenants.
On 26 June 2023 the tenants informed Mr Gally that they were leaving the tenancy the next day.
Mr Gally reminded the tenants of their obligation to give a minimum of 28 days’ notice to terminate a periodic tenancy 1 .
Mr Gally agreed to reduce the notice requirement to 21-days.
The tenancy ended on 16 July.
The tenants left the property before that date, but they remain liable for rent up to 16 July.
The landlord’s rent record establishes rent arrears of $1,050.00 to that date.
On or around 7 July, Ms Hastings requested an “loan” of $400.00, representing a partial refund of the bond in advance of the end of the tenancy.
At that time, the total of rent arrears plus $400.00 was less than the bond, and the landlords agreed to the advance.
The tenants did not make any more rent payments after 20 June.
I am satisfied that the loan was, in effect, the landlords agreeing to refund $400.00 from the bond before the end of the tenancy, relying on the tenants’ undertaking to continue paying rent, which they failed to do.
I also note that the landlords have incurred other costs, including change of locks because the tenants did not return the keys, that they are not claiming from the tenants
The claim presented by the landlords is fair and reasonable.
The tenants must re-pay the advance, in addition to the rent arrears owed to 16 July. The total is $1,450.00.
The landlords have been successful in this application, and I must also award the landlords the filing fee 2 .
