Reasons

[The tenant/s] attended the hearing together with Ms Harrison and Mr Fyfe as representatives for the landlord.
This was a four-year tenancy. The tenants gave notice and vacated the premises on 28 June 2023.
There has been a difference of opinion about some end of tenancy matters affecting the refund of the bond.
After hearing evidence from both parties, my decisions are as follows:- a. The parties will share the cost of changing the locks at the address after a mix-up about whether all keys had been handed over. b. The photos show that additional cleaning of some hard-to-reach surfaces is reasonable, and of the blinds. The landlord acknowledges that the house was mostly reasonably clean (which is how a tenant must leave it). I award the cost to clean the blinds, and 3.5 hours of labour to clean the other surfaces (lights, fly spots, vents). This is $408.86. c. I dismiss the claim for repair of one bottom corner of a wall. The tenants were asked to sign a blank property inspection report at the start of the tenancy so this cannot be relied on as an accurate record agreed to by them. [The tenant/s] recalls that the corner was slightly chipped from the start of the tenancy and that this gradually became worse. I find this to be reasonable wear and tear from a defect already present. d. I award $75.00 towards the cost of cleaning 5 small marks on the lounge carpet. The landlord thinks these are burns. The tenants say they are marks from the feet of a cupboard. There has not yet been an attempt to remedy the marks and they are very small. I dismiss the claim for the insurance excess as do not accept that the damage is enough to justify replacement of a room of carpet. My award is an estimate of the cost to have the spots cleaned.
I make no award for the filing fee.
I suppress the tenants’ names as they have been substantially successful in recovery of the bond and defence of the landlords’ claims. N Maplesden, 06 September 2023
