The landlord had applied for rent arrears and water rates originally. Today at the hearing, the landlord confirm that the water rates arrears claim was withdrawn due to the actual water reading not being able to be done until some three or four months after the end of the tenancy.

The original rent arrears was for $11,880.00 to 5 th June 2023.

After the last hearing on 19 th September 2023, bond of $3,200.00 was released to the landlord and the tenant had paid $2,236.65 towards rent arrears.

The remaining rent arrears was $6,443.45. This was not disputed by the tenant.

Therefore, I order the tenant to pay the landlord $6,443.45 for rent arrears. The tenant’s cross-application

The tenant made a cross-application seeking for compensation for loss of use of the premises due to flooding between 27 th January and 26 th May 2023 as well as reimbursement costs incurred for electrician and drainage workers for the flooding.

The tenant had initially sought 50 percent of rent reduction for the times when the fields were completely flooded. The fields were flooded for 55 days, being 27 th January to 21 st February, 24 th February to 6 th March and 9 th May to 26 th May 2023.

The tenant provided photos to show the flooded fields.

The tenant ran a [redacted] business and had claimed insurance for the flooding also.

As the tenant had been covered by business insurance already, I decline to award 50 percent rent reduction for the loss of use.

However, I acknowledge that there was some loss of use in the tenant’s personal capacity in the use of the premises nevertheless. I award 10 percent rent reduction for the 55 days. That equates to $1,037.14.

In relation to the electrician and drainage workers, the tenant had incurred $1,257.75 herself. The landlord had insurance to cover for the flood damage but the landlord’s insurance company had requested for a breakdown of the invoices provided by the tenant.

It seems that there was a breakdown of communication and the tenant never ended up providing the detailed invoices to the landlord.

The tenant is to provide all the required documents as per the landlord’s request in relation to the electrical and drainage work by 5:00 pm on 31 st January 2024. 4645830, 47065913

Once that is received, the landlord has two months to reimburse the tenant with $1,257.75.
