The tenancy of Kurt Vuletich at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 5 pm on Monday 4 September 2023.
Kurt Vuletich must pay [The landlord/s] $2,120.44 immediately, as per the table below.

Both parties attended the hearing, which was conducted remotely
The landlord has applied for termination of the residential tenancy at [Tenancy address suppressed], rent arrears and refund of the bond. The landlord also seeks a remedy for unpaid lease payments in relation to a separate commercial premises leased by the tenant at the same address. The commercial premises and the residential premises are located on the same property but are not adjoining.
The landlords were under the impression that they could apply to the Tenancy Tribunal for orders in relation to their commercial lease and expressed surprise when the Tribunal advised that the Residential Tenancies Act 1986 does not apply to commercial leases, 1 commenting “why did no one tell us that?”. As commercial landlords, they have plenty of other options available to them, including obtaining basic legal advice, as to how to enforce their commercial lease.
In relation to the residential tenancy at [Tenancy address suppressed], I am satisfied that rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated.
The landlord provided rent records which prove the amount owing as at today of $3150, and this sum was not dispute by the tenant.
The tenant has been unable to afford the rent, and is willing to move out, but has been struggling to find other accommodation. He agrees that he will vacate the commercial premises as well. He has no issue with the amount that is being sought and wants to pay it when he can.
On the landlord’s application, they stated that the bond amount was $1750, however, that was incorrect. A call to the Bond Centre indicated that the bond is only $1050.
Because [The landlord/s] has substantially succeeded with the claim I have reimbursed the filing fee.
