The tenancy of Jamie-Lee Antoinette Burns at 40 Connolly Street, Boulcott, Lower Hutt 5010 is terminated, and possession is granted to [The landlord/s], at
59pm on Wednesday 20 September 2023.
Jamie-Lee Antoinette Burns must pay [The landlord/s] $8,370.44 immediately, calculated as shown in the table below:

Reasons

This application was scheduled to be heard by teleconference. I was unable to get through to Ms Burns on the number provided for her and so the hearing proceeded in her absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 31 August 2023 the landlord became aware that the tenant had abandoned the premises because a neighbour advised the landlord that they heard the tenant leaving the previous evening. A subsequent inspection revealed that the tenant’s belongings had been removed.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. I have ordered the tenant to pay rent to 28 September 2023 because she is required to pay rent in lieu of the 28 days’ notice of termination she is obliged to provide to the landlord.
As well as payment of rent arrears Ms Burns is ordered to reimburse the filing fee to the landlord because they were wholly successful in the claim against her. C ter Haar 20 September 2023
