The landlord attended the hearing. The tenant did not attend the hearing. Background
The landlord’s application had been heard at a hearing allocated for 15 August 2023 which was held by telephone. The Tribunal issued an order dated 15 August 2023.
On 20 August 2023 a document was filed appointing Graham McCready as the tenant’s representative. On the same day Mr McCready filed an application for rehearing on the basis that the tenant had filed a cross application on 14 August 2023 and the tenant claims that he did not receive a telephone call from the Tribunal for the hearing on 15 August 2023.
An order was made on 23 August 2023 granting the tenant’s application for rehearing.
The rehearing hearing was held in person on 30 October 2023. Tenant’s application
The tenant had applied for refund of the bond, a claim relating to the Healthy Homes standards, for compensation and exemplary damages.
The tenant did not attend the hearing at the scheduled time, request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.
