Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 4 September 2023 the landlord became aware that the tenant had abandoned the premises.
The tenant acknowledged and agreed that she had abandoned the property on this date and responsibly accepted that she was liable for rent until 28 September 2023 being the date 28 days after the landlord became aware that she had abandoned the property.
Because the premises have been abandoned and rent is in arrear, the tenancy is to be terminated. Because the tenant has accepted that her tenancy is to terminate and because she would like to remove her possessions and leave the property in a reasonably clean and tidy condition, it is appropriate that she have until the end of the day on 28 September 2023 to do so. The tenancy is therefore terminated at that day and time.
Because Williams Property Solutions Limited As Agent For Jamie & Annie Madigan has wholly succeeded with the claim I must reimburse the filing fee.
