Reasons

Ms Wooler attended the hearing by teleconference on behalf of the landlord. Mr Aiolupotea, a Samoan interpreter, also attended the hearing briefly by teleconference. The phone number provided for [The tenant/s], the last three digits being 175, was called twice. Both calls went to voicemail. As [The tenant/s] was served, the hearing proceeded in his absence and Mr Aiolupotea’s translation services were not required so he left the hearing. The phone number provided for [The tenant/s], the last three digits being 721, was also called, without response.
The landlord has applied for termination and possession, for possession due to squatters, for rent arrears, refund of the bond and refund of the application fee.
During the hearing, Ms Wooler said [The tenant/s] left the property on 5 September 2023, as did the family of the other tenant, Vinetta Galumalemana, who passed away in August 2023. Thus, she withdrew the landlord’s claim for termination and possession, as the property is now vacant.
The landlord provided rent records which prove the amount owing for rent to 5 September 2023, which is $1,678.57.
Because 360 Property Management Limited has been successful with the claim I must reimburse the filing fee.
The Bond Centre is to pay $1,699.01 from the bond of $1,880.00 (3040946- 021) to 360 Property Management Limited immediately.
The balance of the bond of $180.99 is to remain at the Bond Centre, as the landlord advised they are seeking payment from the tenant for post-tenancy cleaning.
