The tenancy of Mohammed Dawood at Unit/Flat 9, 15 Park Avenue, Epuni, Lower Hutt 5011 is terminated, and possession is granted to Brc Limited, at immediately.
Mohammed Dawood must pay Brc Limited $14,595.44 immediately, being rent arrears to 27 September 2023.

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee. Termination
Rent was at least 21 days in arrears on the date the application was filed.
The Tenant submitted the rent arrears were incurred by his flatmate who had moved out of the property on or about 18 November 2022 but stopped paying rent on 8 July 2022. The Landlord submitted that the Tenant was advised in November 2022, that he would be liable for the entire rent so he may want to consider a replacement flatmate. This did not occur.
The Tenant submitted the rent arrears was only $1800.00 because the balance of rent arrears was incurred by his flatmate. No evidence was provided by the Tenant of this.
The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

How much is owed in rent arrears?

The Landlord provided rent records to prove the amount of rent arrears. Joint Tenants are jointly and severally liable for the rent. The Landlord can pursue only one Tenant for the entire rent as the Landlord has done so in this matter.
The Tenant had 24 hours after the Landlord filed their evidence post- hearing to file a reply to the evidence but failed to do so.
