The tenancy of Justine Harwood at 10A Cambridge Road, Manurewa, Auckland 2102 is terminated, and possession is granted to [The landlord/s], at 11.59pm on Thursday 12 October 2023.
The Bond Centre is to pay the bond of $3,000.00 ([Bond number suppressed]) to [The landlord/s] immediately.
Justine Harwood must pay [The landlord/s] $5,710.44 immediately, calculated as shown in the table below:

Reasons

This application was scheduled to be heard by teleconference. I rang the number provided for the tenant twice and both times my call went to voicemail. The hearing proceeded in her absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, reimbursement of the filing fee and payment of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 6 September 2023 the landlord made an application to the Tribunal seeking termination for abandonment and rent arrears, reimbursement of the filing fee and payment of the bond.
A couple of days subsequent to that application the tenant advised the landlord that she was in fact living at the premises.
However on 4 October 2023, the landlord became aware that the property had been abandoned when he went to the premises for a routine inspection. While there were items left at the premises there were no beds and the power was off.
On this evidence I am satisfied that that premises have been abandoned, and rent is in arrear, and so the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing as at 1 November 2023. The amount ordered includes rent in lieu of notice – ie 4 weeks’ notice from 4 October 2023 when the property was found abandoned
Further to this I am ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful in the claim against her. Suppression of landlord’s name
