Reasons

Ms Uerata attended the hearing by teleconference on behalf of the landlord. [The tenant/s], also attended the hearing by teleconference.
The landlord has applied for termination and possession, rent arrears and refund of the application fee. During the hearing, the landlord said the property was vacated on 27 September 2023 and so they withdrew the claim for termination and possession.
The landlord has provided rent records which prove the amount owing to 27 September 2023, which is $3,240.00. The tenant agreed that this amount is owing by her for rent.
Because Western Bay Of Plenty Pm Limited As Agent For Llf Properties Limited has been successful with the claim I must reimburse the filing fee.
The landlord did not request suppression. During the hearing, the tenant requested suppression.
Section 95A(4) Residential Tenancies Act 1986 (“RTA”) provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interest of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.
The tenant said she accepted responsibility for the rent arrears and wants to arrange to pay the debt. She explained she is also struggling to support her young children and ensure they are housed and cared for, with other bills. She said she will arrange with the landlord for regular repayments of the rent arrears debt and consented to an order being made for rent arrears. Based on this evidence, I find that the tenant’s interests in not having her name published outweigh the public interest in publishing her name. Therefore, I order that the tenant’s name and identifying details are not to be published.
