Reliance Property Management Limited is permitted to enter the premises for the purpose of inspecting the premises, at any time between 8 o’clock in the morning and 7 o’clock in the evening after giving 48 hours’ written notice to the tenant on a day specified in the notice before the intended entry. A locksmith may accompany the landlord during the inspection to change the locks and secure the premises accordingly. A key to the new locks is to be provided to the tenant at the same time.

Reasons

Only the landlord attended the hearing.

Reliance Property Management Limited claims the tenant has not allowed them entry to the premises when they were entitled to enter. 48 hours’ notice of inspection has been served by the landlord prior to the landlord’s visit but the landlord had not been able to access the premises as the locks has been tampered with or otherwise removed and the premises boarded up.

A landlord may enter the premises during the tenancy with the tenant's consent, in an emergency, or after giving the required notice for inspections and repairs and maintenance. See section 48(1) and (2) Residential Tenancies Act 1986.

Breaching this obligation without reasonable excuse is an unlawful act for which exemplary damages may be awarded up to a maximum of $1,500.00. See section 48 (4)(b) and Schedule 1A Residential Tenancies Act 1986.

The Tribunal is also able to make an order for pursuant to section 48(2)(e) RTA allowing the landlord to enter the premises where the tenant has, without reasonable excuse, denied the landlord’s access to the premises.

I am satisfied that access should be provided to the landlord after the landlord has served the required notices to the tenant.

The tenant has also apparently breached section 46(2) RTA when the existing lock has been tampered, altered or removed from the premises without the consent of the landlord.

In the circumstances, I consider it appropriate to issue an order pursuant to section 48(2)(e) RTA permitting the landlord to enter the premises for the purpose of inspecting the premises, at any time between 8 o’clock in the morning and 7 o’clock in the evening after giving 48 hours written notice to the tenant on a day specified in the notice before the intended entry.

The landlord may also engage a locksmith to accompany the landlord during the inspection to change the locks and secure the premises accordingly. A key to the new locks is to be provided to the tenant at the same time.

There will also be an order for the tenant to pay water rates outstanding.
