The landlord attended the hearing. The tenant did not.
The tenant did not provide an email address on the tenancy agreement. The tenant’s mobile phone number, which is the address for service provided in the tenancy agreement, was called and the tenant did not answer. The mobile phone number is still in service but goes straight to voicemail.
Notice was also sent to the tenancy address and is deemed to have been properly served on the tenant. Refer s91A of the Residential Tenancies Act 1986 (“the Act”).
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 of the Act. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 11 October 2023 the landlord became aware that the tenant had abandoned the premises. He has not answered any of the landlords calls nor returned the calls, despite being left voicemail. The tenant has told others in the building that he is moving out and when the landlord went to the flat she found the flat unsecured and only an old bed base and fridge left in the premises. All the tenant’s other personal belongings were gone and there were no signs anyone had been living there. He has not returned the keys and the landlord has not been able to find where he went.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.
