The landlord’s agent attended the hearing which took place by teleconference. Both tenants were called on the numbers provided but the calls went to answerphone. The file records that the tenants have been sent notice of the hearing therefore the hearing proceeded in their absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
The landlord issued a 14-day notice to remedy rent arrears on 15 September 2023. The notice was not remedied.
The landlord applied to the Tribunal on 28 September 2023.
The landlord advised that the tenants are not responding to attempts to contact them to resolve matters. They understand from the owner that Tyler Ashley has moved to Australia and Solomon Harry is still in the premises.
