[The tenant/s] must reinstate her weekly rent payments and pay the debt in full by Sunday 19 November 2023.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If [The tenant/s] fails to pay the rent arrears within 2 working days of 19 November 2023: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If [The tenant/s] fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing which was held remotely by teleconference.
[The tenant/s] is considerably in rent arrears due to a period of illness. She is however in the process of seeking assistance with the debt from Work and Income New Zealand (WINZ).
Where rent is at least 21 days in arrears on the date the application was filed, as it was here, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
The parties have agreed, and as such I have granted a conditional termination order.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
This means that [The tenant/s] must pay the debt, hopefully with the assistance of WINZ within the next week. She must also continue to pay her weekly rental payments. If she does not pay the debt within the required time, the landlord is entitled to end the tenancy.
Because [The applicant/s] have wholly succeeded with the claim I must reimburse the filing fee.
Because this order is made by consent, it is appropriate for me to redact the parties’ names from the published order.
