Reasons

Both parties attended the hearing by remote teleconference.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
I have also sighted an updated rent ledger dated 17 November 2023 which was provided to the Tribunal today. The tenant disputes the arrears.
The property was initially managed by Bayleys Real Estate. The current property manager took over approximately one week after the tenant moved in. The tenancy agreement was fixed for a period of three months.
The tenant says that the start date of the tenancy was not 21 August 2023 but rather two weeks later. She also says that the premises did not comply with the Healthy Homes Standards. She says that the property was not liveable.
There is no evidence before me of a different start date. The landlord confirms that the rent ledger as filed in support is accurate.
The tenant has not filed a cross application in respect the issues raised. I can only deal with the application before me relating to rent arrears. The landlord’s evidence fully supports the claim for rent arrears. I have also sighted the Tenancy Agreement signed by both parties on 15 August 2023 with a start date of 21 August 2023. The first rent ledger also confirms a rental period start date of 21 August 2023.
Based on the evidence filed by the landlord in support of the application I find that the arrears are proven. It will be a matter for the tenant whether she wishes file a separate application in respect of issues raised.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
The Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case – section 95A Residential Tenancies Act.
The landlord applied for a name suppression order. The landlord is entitled to name suppression as the application is successful – see section 95A RTA.
