Both parties attended the hearing which was held by teleconference. Ms Russell-Waimotu advised that she was representing both herself and Mr Renata-Cavanagh.
The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment of the bond.
Rent was at least 21 days in arrears on the date the application was filed and so the Tribunal must terminate the tenancy. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing as at today’s date - $6,572.78. I note that part of the rent has been automatically paid by WINZ on a Monday. While the last such payment reflected in the rent record was made on Monday 27 November 2023, another payment would most likely have been paid by WINZ yesterday, 4 December 2023, which has not been received as yet into the landlord’s account. If it has been made then the rent owing as at today’s date would be $6,202.78.
I am also ordering the tenants to reimburse the filing fee to the landlord because [The landlord/s] has wholly succeeded with the claim.
