The landlord provided rent records which prove the amount owing at the end of the tenancy. The Landlord cannot enforce the order until 8 December 2023, at which time the rent arrears are $2,914.29.

The tenant made a counter claim for $2,852.00 of work he claims his business Green Ganesha Services undertook on the premises with the consent of the owner of the property in exchange for a corresponding reduction in rent arrears. The tenant was unable to prove that the landlord accepted the quotation provided to him on 19 August 2023 or that the landlord had agreed to offset rent arrears in payment for the quoted services. The property manager provided evidence of instructions from the landlord that he did not accept the quote and had received quotes at a cheaper rate from other providers. In the communications provided, the owner expressed to the property manager that he had felt bullied and threatened into accepting this kind of arrangement with the tenant in the past but was not going to accept these kinds of arrangements any further and instructed the property manager not to engage the tenant to undertake any work on the property. Therefore, I declined to accept the counterclaim for the offset of rent arrears the tenant claimed based on his company’s invoice INV-2563 dated 19 August 2023. The property manager gave evidence that this invoice was not provided to her until after she had made the application to the Tribunal on 24 October 2023 to have his tenancy terminated/possession of the premises.

Because Asset Property Care Ltd T/A Browns Bay Property Management Ray White As Agent For Yakin & Kanogphan Archvarin As The Trustees For The Archvarin Family Trust has wholly succeeded with the claim I must reimburse the filing fee.
