The landlord attended the hearing by telephone.
The tenant emailed the Tribunal this morning advising that he would not be attending the hearing due to him attending a tangi.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
I have considered whether it would be appropriate to make a conditional order under section 55(1A) RTA.
I have determined that it is not appropriate because: a. The rent is not just 21 days in arrears. It is 77 days in arrears. b. The amount owing represents a significant sum over and above the bond. c. The tenant has been in significant arrears for much of the tenancy. d. The tenant failed to attend mediation to deal with the arrears. e. The landlord advised that the tenant has promised to have the arrears covered by WINZ before but no payment has been made. f. The tenant has not provided any evidence in support of his claimed reason for not paying his rent. g. No rent at all has been paid in since 6 December 2023.
Because Naturally Keen Limited (T/A Keen On Rentals) - As Agent For Okleo Ltd has wholly succeeded with the claim I must reimburse the filing fee.
