Reasons

The landlord attended the hearing which was held by teleconference. The other party did not attend. Ms Yates and Mr Brown were contacted by the Tribunal on the contact numbers provided in the application but without success. I am satisfied that there has been adequate service of the hearing notice and proceeded with the hearing in the absence of Ms Yates and Mr Brown.
The landlord has applied for compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The landlord proved with evidence that the tenants did not leave the premises reasonably clean and tidy and did not remove all the rubbish from the premises. The landlord’s evidence is undefended.
The landlord relied on the exit property inspection report, photographs and invoice.
I accept there was cleaning to be done throughout the property. The carpet needed a vacuum and other floor areas needed a mop. There were cobwebs and dust throughout. All cupboards and drawers needed wiping out of food and marks. Light fittings/shades had flyspots and dust. Some rubbish left inside needed to be removed. There were fleas in the carpet, mostly in the hallway and the end two bedrooms. Lawns and gardens needed tidying up. The garage had new oil stains and a large engine with some rubbish around it and needed sweeping out.
The photographs produced by the landlord of the condition of the property at the end of the tenancy, show that while some cleaning may have been done there were areas missed or overlooked that needed addressing to bring it up to a reasonably clean standard.
The landlord had to replace light bulbs.
The amounts ordered are proved.
