Ms Luckman, on behalf of the landlord, and the tenant, [The tenant/s] both attended the hearing by teleconference.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing to 19 October 2023, which is $1,634.49. This included a credit of $44.08 from the bond which was released to the landlord.
The tenant consented to an order being made for payment of rent arrears in the amount of $1,634.49.
There are other issues relating to the end of the tenancy and bond, which the parties are discussing outside of this Tribunal claim. No claim has been filed about these and so no findings are required about the bond or any compensation issues, despite the landlord filing evidence in relation to these issues.
Because Gold Property Management Limited T/As Harcourts Gold Property Managment Ltd As Agent For Margaret Shackel has wholly succeeded with the claim I must reimburse the filing fee.
The tenant requested suppression. The landlord did not request suppression.
Section 95A(4) Residential Tenancies Act 1986 provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.
The landlord said the tenant was a really good tenant and what occurred at the end of the tenancy did not reflect the positive dealings they had with the tenant for most of the tenancy. The landlord believed the tenant should not be penalised by having her name published, because of circumstances she had experienced at the end of the tenancy. The tenant said she would like name suppression, given her personal circumstances. Given the evidence and that both parties also consent to name suppression for the tenant, I find that the tenant’s interests outweigh the public interest in publishing her name. Therefore, I order that the tenant’s name and identifying details are not to be published.
