Reasons

The hearing took place on 10 January 2024. [The landlord’s representative] represented [The landlord/s] at the hearing. There was no appearance by the tenant.
The landlord’s rent record shows that the last rent payment was made on 4 October 2023.
On 1 November 2023, [The landlord’s representative] received information indicating that Mr Thompson was not residing at the property. [The landlord/s] attempted to contact Mr Thompson so that he could give written notice to terminate the tenancy.
On 5 December 2023, Mr Thompson’s partner returned the key to [The landlord/s] office and advised [The landlord/s] that Mr Thompson was not returning.
Most of Mr Thompson’s personal belongings were removed.
Tenants must give 28 days’ notice in writing to terminate a periodic tenancy 1 .
If a tenant leaves the property without giving notice, they have abandoned the tenancy.
Where a tenant abandons a tenancy, they remain liable for rent to the date that is 28-days from the date that the landlord discovered the abandonment.
In this instance the abandonment was confirmed on 5 December 2023.
Mr Thompson is liable for rent arrears to 3 January 2024. The amount of arrears to that date is $1,567.44.
[The landlord’s representative] provided a list of the items that remain at the property, and photographs of those items.
I am satisfied that the abandoned items have no market value beyond the cost of storing and selling them.

The landlord has been successful in this application, and I must also award the landlord the filing fee of $20.44.
