The landlord claimed $345.00 for cleaning costs but provided limited evidence in relation to the cleanliness at the end of the tenancy. Based on the photographs and evidence from the landlord, I award $120 for cleaning costs.
The tenant did not return keys.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The following damage was caused during the tenancy: painted surfaces were damaged by dark paint applied in a substandard manner, hole in wall between lounge and bedroom, screws into wall. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The amounts ordered are proved.
The landlord did not provide evidence that other damage occurred during the tenancy. A claim for a cupboard repair ($34.50) was withdrawn at the hearing.
The landlord did not establish claims in relation to replacement vinyl or a backdoor. Those claims are dismissed.
As the landlord was partially successful, I have awarded reimbursement of the filing fee.
