Both parties attended the hearing which took place by telephone.
The landlord has applied for termination of the tenancy and rent arrears and reimbursement of the filing fee.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (RTA).
I heard submissions from the tenant setting out how the arrears had arisen. The landlord was unwilling to accept the payment plan put forward by the tenant particularly in the light of the fact this was the second occasion the tenant had been before the Tribunal and a conditional order had already been made on 17 July 2023 in Tenancy Tribunal case 4599489. That order had not been complied with. In fact, the tenant’s arrears have never been cleared since this order was made.
The landlord provided rent records which prove the amount owing at the end of the tenancy. Rather than seek immediate possession the landlord was satisfied the tenant could remain for one further week. The tenant wanted this additional time.
The order made on 17 July 2023 in Tenancy Tribunal case 4599489 awarded the landlord a sum for arrears ($336) and the filing fee ($20.44). This order has not been enforced by the landlord. All payments made by the tenant have been included in the landlord’s rent summary.
I have therefore incorporated the order made on 17 July 2023 in Tenancy Tribunal case 4599489 into this order. The order in case number 4599489 should now not be enforced because the tenant’s debt for rent arrears in that order is now included in this order.
