Both parties attended the hearing, conducted via teleconference.
The landlord has applied for rent arrears and a top up of the bond.
The landlord provided rent records which prove the amount owing is $880.00. This was agreed as accurate by the tenant.
The rent is paid weekly but a correctly served rent increase of $80.00 from 10 December 2023 has not been added to the weekly payment of $280.00. The tenant has a meeting with his support agency to discuss this. It is expected that meeting will address the rent arrears as ordered here, as well as amending the weekly rent payment to reflect the current weekly rent of $380.00.
Section 18(2) of the Residential Tenancies Act 1986 provides that on the lawful increase of the rent, the landlord may require payment by way of bond of a further sum not exceeding the amount by which the rent payable for 4 weeks has been increased. The landlord has previously requested the bond to be topped up but this was not done at that time. Four weeks bond at the current rent is $1,440. The current bond is only $560.00 and a further payment of $880.00 is required to the establish the bond at the maximum level as required by the landlord. Application filing fee
