Reasons

The landlord attended the videoconference hearing, the tenants did not attend. The Tribunal rang both tenants on the mobile numbers provided in the tenancy agreement. Courtney’s phone disconnected and Karl’s went to answer phone.

The landlord advised that she had gone to the property today, on the morning of the hearing. Karl was still at the property, and he was reminded of the hearing this afternoon.

The tenants have been provided with correspondence and reminders from Tenancy Services regarding the hearing. I am satisfied that both tenants knew of this hearing. Landlord application:

The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and refund of the bond.

The tenant, Courtney Boyd, had given notice to the landlord that she was leaving the tenancy on 23 February 2024. It appears that Courtney did leave on 23 February 2024, but Karl was still at the property this morning packing up his property. Regardless of Courtney’s notice I am going to order termination of the tenancy and possession to be given back to the landlord immediately. Termination:

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The tenancy is terminated at 11.59pm on Monday 26 th February 2024. Rent arrears:

The landlord provided rent records which prove the amount $12640.93 owing at the end of the tenancy on 26 th February 2024.

This tenancy commenced in April 2022, with the owner of the property managing it rather than a property manager. The owner allowed the rent arrears to mount up to $6400.00 over the period of April 2022 to December 2023.

On 7 December 2023, the owner handed the management of the property to McDowell Property Management Ltd. The tenants have not paid rent during the time that the new property management company have been taking care of the property and the rent arrears from December 2023 to 26 February 2024 amount to $6240.93. The total rent arrears over the term of the tenancy are $12640.93.

I am satisfied that the landlord has proven their claim for rent arrears. Bond:

The bond is to be refunded immediately to the landlord to offset the debt owed by the tenant.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.

The landlord seek suppression of their name and details and as they have been successful with their application, I am granting suppression.
