The landlord attended the hearing. The tenant did not.

The tenant has been sent a notice of hearing to the email address on the tenancy agreement that she provided as an address for service. The landlord contacted the tenant yesterday to confirm that the tenant knew about the hearing today. I have called the tenant today on the mobile number she provided to the landlord. This is the same number the landlord has communicated with the tenant on from the beginning of the tenancy. The call went to voice mail. The tenant then sent a text message to the landlord stating that she could not answer the call, was not going to be attending the hearing today and was trying to get a loan to pay the rent arrears.

I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.

The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.

The landlord gave evidence that it has had a previous Tribunal hearing where it sought to terminate the tenancy based on the rent having been in arrears for more than 21 days at the date of the application. The tenant failed to attend that hearing and then applied for a rehearing, citing a miscarriage of justice as she had not be present at the hearing and so unable to provide a defence to the landlord’s claims. The landlord also gave evidence that the tenant requested more time to pay the arrears as she was seeking to borrow money to pay the arrears. She was given that time and is still in significant rent arrears and showing no signs of being able to meet her statutory or tenancy agreement related obligations to pay her rent in full and on time each week.

The landlord considers that it has no other option at this point but to seek termination and possession orders.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The records show that the tenant has never made payment of the full rent on the due dates from the beginning of the tenancy to the date of this hearing. Reimbursement of the filing fee

Because Rent Wise Property Management Limited As Agent For Owner has wholly succeeded with the claim I must reimburse the filing fee.
