Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The tenants did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord claimed $1,056.40 for cleaning costs and rubbish removal and provided photographs and an invoice to support its claims.

The tenants disputed the claims but did not provide any photographs or independent evidence of what they claimed a reasonable cleaning cost would have been. The tenants challenged aspects of the landlord’s photographs as not being representative of the condition of the property, or of not showing areas claimed for.

The photographs speak for themselves. The landlord has claimed primarily for cleaning of a kitchen and six bathrooms. Those areas were not reasonably clean. The invoice records 9 hours were spent at the premises cleaning (plus the oven cleaning time). That is a reasonable amount of time based on the photographs.

I have awarded the amount claimed except for $172.50 for steam cleaning mattresses and $60 of the amount invoiced for dumping. There was no evidence that the mattresses were not reasonably clean; rather they were steamed by the landlord as a matter of good practice. There was evidence that the green bin was not completely empty at the start of the tenancy. The tenants should not be required to meet the full cost of rubbish removal at the end.

As the landlord was substantially successful, I have awarded reimbursement of the Tribunal application fee.
