The landlord attended the hearing, the tenant did not attend. The Tribunal rang the tenant on the mobile number provided in the application, but it went to answerphone.
The landlord has initially applied for rent arrears and water bills. However, prior to the hearing the tenant paid the rent arrears in full. The landlord has withdrawn her application for rent arrears. The only matter before the Tribunal today is water bills. The landlord has provided water records which prove the amount of $3700.00 owing.
I am satisfied that the landlord has proven their claim for the water bills.
The water bills are high, and the tenant has raised concern that the water metre is faulty. The landlord has had a plumber attend the property and check the water metre for faults. It appears that the water company that services this area has much higher charges for consumers than other providers. A copy of the plumber’s report has been provided to the tenant.
The landlord is seeking to release the bond to offset the debt owed by the tenant to the landlord. I am directing that the bond is refunded to the landlord immediately.
The landlord has explained that this tenant is a good tenant and looks after the property really well. The landlord sought suppression of their name and details and the tenant details. The landlord did not want the tenant to have difficulties in obtaining a tenancy at a later stage in his life, because of this Tribunal hearing.
I am granting suppression of both parties given that the rent arrears were resolved before the hearing and the water bills relate to a genuine concern about the price of the water bills. The landlord shares the tenant views of the cost of water to residents in the Papakura area. It is not a case of the tenant simply choosing not to pay his bills.
