Amanda Morgan owes The Rent Shop Limited - As Agent For Gong Ting Liu $11,620.44 (“the debt”), calculated as shown in the table below:
Amanda Morgan must pay rent and the debt as follows: a. By a lump sum payment of $11,600.00 on Wednesday 26 June 2024 for the debt; b. By payment of the normal weekly rent of $1,450.00 in full and on the due date; c. By payment of $20.44 on or before Wednesday 10 July 2024, being the filing fee reimbursement.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 45 Harry Dreadon Road, Opaheke, RD 4, Papakura 2584 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing which was held by teleconference.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations and rent arrears.
The landlord provided rent records which prove the amount owing.
The tenant advised that payment of $11,600.00 had been paid today but as at the time of hearing had not yet shown in the landlord’s records.

Should a conditional termination order be made?

Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
Significant rent arrears have accumulated, which would clearly justify termination. It is noted that the tenant is currently looking for a more affordable rental and will liaise further with the landlord once a property is found. In the meantime, the parties have agreed to the above conditional termination order.
The above Order provides protection to the landlord for a period of three months and will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
As the landlord has wholly succeeded with the claim, I must order the other party to reimburse the filing fee.
