An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
The tenancy of Jedidiah Ihipa Hita, Manu Peterson and Ezra Cunningham at 6 Yeats Grove, Trentham, Upper Hutt 5018 is terminated, and possession is granted to [The landlord/s], at 11.59pm on Sunday 10 March 2024.
The Bond Centre is to pay the bond of $2,920.00 ([Bond number suppressed]) to [The landlord/s] immediately.
Jedidiah Ihipa Hita, Manu Peterson and Ezra Cunningham must pay [The landlord/s] $2,366.41 immediately, calculated as shown in the table below:

Reasons

Both parties attended the hearing which took place by telephone.
Mr Cunningham and Mr Peterson attended the hearing. Mr Hita was telephoned but did not answer the telephone. In any event, service on one tenant amounts to service on all so he has been served and the hearing could proceed in his absence.
I am satisfied that [The landlord/s] may bring this application as a landlord. The bond is held in their name at the Bond Centre and they manage this tenancy on a day to day basis serving all notices, doing inspections and collecting all rent. Both the tenants and [The landlord/s] consider [The landlord/s] to be the landlord.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
I am satisfied the three current tenants are the named tenants in this application. The landlord provided evidence in the form of change of tenant forms.
While Mr Hita may no longer be living at the property he remains a tenant so is jointly and severally liable for the rent arrears with the other tenants.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy. Liability for the present arrears arose after the tenants had taken over the tenancy. The rent summary proves that the amount owing to 9 March 2024 is $5,147.40. I have awarded the landlord an additional day’s rent on top of this to allow for the fact the landlord was willing to give the tenants until 10 March 2024 to move out. The tenants confirmed they wanted this.
Because the landlord has wholly succeeded with the claim I must reimburse the filing fee. I also have awarded the landlord name suppression as they have requested it and they have been the successful party (s95A, RTA).
