[The tenant/s] also known as [The tenant/s] must pay Kāinga Ora–Homes And Communities $642.00 immediately, calculated as shown in the table below.

Kāinga Ora–Homes And Communities, on taking possession of the premises, will make an inventory of the tenant’s belongings and goods (“the goods”) situated at the premises and must secure those goods in safe storage on the following terms: a. The goods must be secured in safe storage until the tenant collects the goods; b. The goods must be collected by the tenant on a date to be agreed with the landlord and within a time period that is reasonable in the circumstances; c. In the event that the landlord and the tenant cannot agree on a collection date, the landlord may apply to the Tribunal for disposal orders under section 62B Residential Tenancies Act 1986.

The landlord has applied for termination of the tenancy and rent arrears.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy.

The landlord acknowledges that the tenant is being held in custody and has advised that he is expecting to be released on home detention on 13 March 2024. He had hoped he could retain the tenancy for that purpose. However, the landlord did not agree to this and is entitled to seek termination. As a social housing provider, the landlord has a duty to ensure homes are made available and used by tenants as their primary residence. They cannot hold premises for tenants in situations where they are absent from the home for more than 30 days (see clauses 26 and 27 of the tenancy agreement).

However, the landlord noted that the tenant in this case may apply for further housing through MSD, and it is likely his application will be given priority given that he must be bailed to an approved address for home detention.

I am suppressing the tenant’s name and identifying details given that the matter of his being held in custody is the reason he has been unable to pay rent and unable to reside at the premises, rather than an intentional breach. I consider that those details should not be published because they are not in the public interest.
