Reasons

Amanda Galuszewski attended the hearing for the landlords’ agent.
The tenants did not attend. The tenants are aware of the hearing. It proceeded in their absence.
The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee, and payment over of the bond.
Rent was not at least 21 days in arrears on the date the application was filed. However, it was 21 days in arrears days later and the arrears are now 52 days in arrears.
Although, the tenant tenants have not attended today, I accept Ms Galuszewski’s evidence that they are in the process of moving out and will have done so by tomorrow. It’s in their interests that the tenancy is ended as soon as possible to avoid a higher rent arrears order.
The tenancy is therefore terminated by consent.
The landlord provided rent records which prove the amount that will be owing for rent arrears at the end of the tenancy tomorrow.
The Tribunal must order the tenants to reimburse the landlord for the filing fee because the landlord has wholly succeeded in its application.
The bond is to be paid out to the landlord in the circumstances.
