The tenants applied to rent the property noting on the application form that they had two cats. The application was initially accepted but they were later contacted by the landlord to say that the owner would not accept pets.
The tenants made alternative arrangements for the cats and signed the tenancy agreement on 11 January 2024. Unfortunately, the arrangements for the cats fell through.
On 12 January 2024 the tenants contacted the landlord to advise that they could not go ahead with the tenancy and asked to withdraw the application.
The landlord agreed to release the tenants from their obligations on the basis that they would pay rent until a new tenant was found and that they would cover the landlord’s actual costs relating to the lease break.
A document outlining these terms and providing an example of the costs that may be incurred was emailed to the tenants, signed by them and sent back on 12 January 2024.
The landlord provided evidence that a new tenancy, at the same rent, commenced on 9 February 2024. The tenant is liable for rent from the intended start date (18 January 2024) to the date of commencement of the new tenancy (22 days at $100 per day).
