Mr King attended the hearing by teleconference on behalf of the landlord. Mr Jacobs, the tenant, also attended the hearing by teleconference.

The landlord has applied for termination of the tenancy and rent arrears.

The tenant said he is on a benefit and has his rent paid by the Ministry of Social Development (“MSD”), that MSD has disrupted and missed some rent payments, which had caused the rent arrears.

From the rent summary provided by the landlord, rent went into arrears around 3 January 2024.

Mr Jacobs confirmed he had received three notices of recidivist rent breaches from the landlord, dated 15 January 2024, 17 January 2024 and 24 January 2024. He said he had tried calling MSD twice to ask them to sort out the rent arrears but had got cut off and not got through.

I note the last notice of recidivist rent breach by the landlord was dated 24 January 2024 and the tenant still had not sorted out the rent arrears situation by the hearing date on 28 March 2024, which was 2 months after that last notice.

The landlord provided a letter from the owner indicating the stress that the rent arrears has caused for his family.

Rent was at least 21 days in arrears on the date the application was filed (see section 55(1)(a) of the Residential Tenancies Act 1986 (“RTA”)) and the three notices of recidivist rent breaches all complied with the requirements of section 55(1)(aa) of the RTA. Therefore, the tenancy is terminated.

The landlord provided rent records which prove the amount owing to 2 April 2024, which is $1,000.00. Weekly rent is $500.00 so daily rent is $71.42. A further one week’s rent of $500.00 is payable from 3 April 2024 to 9 April 2024. Then a further 3 days’ rent @ $71.42/day is payable for 10 April 2024 to 12 April 2024, for a sub-total of $214.26. Therefore, the tenant owes the landlord $1,714.26 in rent to 12 April 2024, which is the end of the tenancy. Filing fee

Because Rent Right Property Management Limited As Agent For Viris Limited has been successful with the claim I must reimburse the filing fee. Suppression

The landlord did not request name suppression. The tenant did request name suppression.

I find there was no evidence discussed at the hearing or provided by the tenant that indicated that the personal circumstances of the tenant outweigh the public interest in publishing his name, pursuant to section 95A(4) RTA. Therefore, I do not grant name suppression to the tenant.
