The tenancy of Cecilia Raftstrand at 15 Arlose Place, Westgate, Auckland 0614 is terminated, and possession is granted to [The landlord/s], at 11:59pm on Friday 12 April 2024.
Cecilia Raftstrand must pay [The landlord/s] $5,203.17 immediately, calculated as shown in the table below:

[The landlord’s representative] attended the hearing by teleconference on behalf of the landlord. The phone number for the tenant, the last three digits being 533, was called twice without any response. As the tenant was served, the hearing proceeded in her absence.
The tenancy agreement named two tenants. The landlord provided a copy of a notice to vacate from the other tenant who was not named in the application, and a relinquishment form signed by both tenants saying Ms Raftstrand was to assume responsibility for the belongings left and any damages. It appears that the other tenant not included in this application left the tenancy within a short notice period that was accepted by the landlord, due to the tenants’ relationship ending. From these two documents, and the evidence of the landlord confirming the arrangements, I find it likely that the other tenant left the tenancy and Ms Raftstrand assumed the tenancy obligations from there. As such, the hearing proceeded with just Ms Raftstrand named as the tenant.
The landlord has applied for termination of the tenancy, rent arrears and refund of the application fee.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).
The landlord provided rent records which prove the amount owing to 2 April 2024, which is $4,965.43. Weekly rent is $152.00 so daily rent is $21.71. A further 10 days’ rent @ $21.71 is payable from 3 April 2024 to 12 April 2024, for a sub-total of $217.00.
